3. Professional Indemnity Insurance
Certus Spatial Solutions Ltd holds Professional Indemnity Insurance, meeting the standards required by RICS. Cover extends to the professional services described in this document. Details of our cover, including cover applicable to specific services, are available on request.
4. Scope of Services
The specific scope, deliverables, timescales and fees for each survey are agreed with the client in writing before work commences, typically by way of a written quotation or engagement letter. These Terms and Conditions apply alongside, and in the event of conflict are subordinate to, the terms set out in that written agreement.
Surveys are carried out with reference to the RICS Measured Surveys of Land, Buildings and Utilities ,3rd edition. It remains the client's responsibility to review deliverables on receipt and to confirm they represent a reasonable record of the property for the intended purpose.
5. Subcontractors
Certus Spatial Solutions Ltd may engage subcontractors to assist with CAD drafting and other aspects of survey delivery. All work carried out on our behalf is subject to confidentiality obligations. Certus remains fully responsible for the quality and accuracy of all deliverables provided to the client, regardless of whether any part of the work was carried out by a subcontractor.
6. Client Obligations
The client is responsible for:
providing accurate information about the size and scope of the property at the time of instruction, including any outbuildings or structures to be included in the survey;
arranging safe and reasonable access to the property at the time agreed, and ensuring Certus's representative can access all areas required for the survey;
confirming that Certus has the necessary permissions to attend and survey the property, including consent from any relevant third party (such as a landlord, tenant, or managing agent) where applicable.
Where access cannot be arranged as agreed, resulting in an additional site visit, this may be charged separately.
7. Fees and Payment
Fees are quoted on a case-by-case basis, taking into account factors including location, property size, complexity, access requirements and time on site. A written quotation is provided before any work commences, and no work will begin without the client's agreement to that quotation.
A deposit of 50% of the quoted fee is required before work commences. The remaining balance is invoiced once drawings are complete, and final deliverables (including drawings, CAD files and reports) will be issued upon receipt of full payment.
Payment should be made within 7 days of the invoice date. If the invoice is not settled by this date, we reserve the right to charge statutory interest at 8% above the Bank of England base rate on the amount unpaid, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
Where necessary, up to three minor amendments to draft drawings will be made free of charge following delivery. Certus reserves the right to charge for further amendments beyond this.
8. Cancellation Policy
Appointments may be cancelled or rescheduled free of charge with at least 7 days' notice.
Cancellations received with less than 7 days' notice may incur a cancellation charge of up to 50% of the quoted fee, to reflect costs already committed, including equipment hire. Where a deposit has already been paid, this will be retained in full or part settlement of the cancellation charge.
Where an appointment has already taken place and work has commenced, the client will be responsible for all costs incurred by Certus Spatial Solutions Ltd up to the point of cancellation, which may be the full contract price.
9. Liability
Certus Spatial Solutions Ltd will provide services with reasonable skill and care, in accordance with the standards expected of a RICS-regulated firm.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
Subject to the above, our total liability to the client for any claim arising from the services provided shall not exceed £500,000, being the level of our Professional Indemnity Insurance cover. We shall not be liable for any indirect, consequential loss, or loss of profit arising from the use of survey data or deliverables..
